Last Updated: May 3, 2026
FLA 239 Properties, LLC, a Delaware limited liability company ("FLA 239 Properties," "we," "us," or "our"), respects your privacy and is committed to handling Personal Information responsibly. This Privacy Policy (the "Policy") describes how we collect, use, disclose, retain, and protect Personal Information that we obtain through this website (fla239properties.com) and its subdomains (collectively, the "Site"), as well as the choices and rights available to you with respect to that information.
This Policy applies only to information collected through the Site. It does not apply to information collected through offline channels or through separate processes such as rental applications, lease agreements, tenant screening, vendor onboarding, or property purchase contracts, each of which is governed by its own notices, disclosures, and contractual terms provided to you at the time of collection.
Capitalized terms used but not defined in this Policy have the meanings given to them in our Terms & Conditions. By accessing or using the Site, you acknowledge that you have read and understood this Policy.
1. Scope and Applicability
This Policy applies to all visitors, users, and others who access the Site, including prospective and current tenants, property sellers, vendors, business counterparties, and members of the general public. Where applicable law (including, without limitation, the California Consumer Privacy Act, the California Privacy Rights Act, and other state privacy statutes) provides additional rights or imposes additional obligations, those provisions are incorporated into this Policy with respect to residents of the relevant jurisdictions.
2. Information We Collect
We collect only the information that we reasonably require in order to operate the Site and respond to inquiries. The categories of information we may collect include:
a. Information You Voluntarily Provide.
When you submit a message through our contact form, we collect the name, email address, subject line, and message content that you provide. You may also voluntarily provide additional information by including it within your message.
b. Technical and Server Information.
When you access the Site, certain information is automatically transmitted by your browser or device to our hosting infrastructure, including Internet Protocol (IP) address, browser type and version, operating system, the referring page, the pages you request, and the date and time of access. This information is processed for the limited purposes of operating, securing, and troubleshooting the Site.
c. Cookies and Similar Technologies.
We do not use advertising cookies, marketing pixels, or cross-site tracking technologies on the Site. The Site may use a limited number of strictly necessary cookies or equivalent local storage mechanisms required for the Site to function (for example, to preserve form state during a session). You may configure your browser to refuse cookies or alert you when cookies are being sent; however, certain portions of the Site may not function correctly if you do.
d. Information We Do Not Collect.
We do not knowingly collect financial account numbers, government-issued identification numbers, biometric data, precise geolocation data, or sensitive Personal Information through the Site. Please do not submit such information to us through the contact form.
3. How We Use Personal Information
We use the Personal Information we collect for the following business purposes:
- To respond to your inquiries, requests, and correspondence;
- To evaluate prospective rental, vendor, and acquisition opportunities that you initiate;
- To operate, maintain, secure, and improve the Site;
- To detect, investigate, and prevent fraudulent, abusive, or unauthorized activity;
- To comply with applicable laws, legal process, and regulatory obligations; and
- To establish, exercise, or defend legal claims.
We do not sell, rent, or lease Personal Information to third parties, and we do not use Personal Information for cross-context behavioral advertising.
4. Legal Bases for Processing
Where required by applicable law, we rely on one or more of the following legal bases to process Personal Information: (a) your consent, where consent is required; (b) the performance of a contract or pre-contractual measures undertaken at your request; (c) compliance with a legal obligation; and (d) our legitimate interests in operating, securing, and improving our business, where those interests are not overridden by your rights and freedoms.
5. Disclosure of Information
We disclose Personal Information only as described in this Policy and only to the extent reasonably necessary for the purposes set forth herein. Categories of recipients include:
a. Service Providers.
We engage third-party service providers to perform functions on our behalf, including website hosting, email delivery (for example, a transactional email provider used to deliver messages submitted through the contact form), security monitoring, and information technology support. These providers are bound by contractual obligations to process Personal Information only as instructed by us and to maintain appropriate confidentiality and security measures.
b. Professional Advisors.
We may share Personal Information with our attorneys, accountants, auditors, insurers, and other professional advisors where reasonably necessary to receive their services.
c. Legal and Regulatory Disclosures.
We may disclose Personal Information to governmental authorities, regulators, or other third parties where we believe in good faith that such disclosure is required by applicable law, subpoena, court order, or other legal process, or is reasonably necessary to enforce our rights, protect the safety of any person, or investigate suspected wrongdoing.
d. Business Transactions.
In the event of a merger, acquisition, financing, reorganization, sale of assets, dissolution, or similar transaction or proceeding involving FLA 239 Properties, LLC or any of its affiliates, Personal Information may be disclosed or transferred as part of the transaction, subject to customary confidentiality protections.
6. Data Retention
We retain Personal Information for the period reasonably necessary to fulfill the purposes for which it was collected, including to respond to your inquiry, to maintain records of our communications, and to comply with applicable legal, accounting, or reporting requirements. When Personal Information is no longer required, we will take reasonable steps to delete it or to render it irreversibly de-identified.
7. Information Security
We maintain administrative, technical, and physical safeguards designed to protect Personal Information against accidental, unlawful, or unauthorized destruction, loss, alteration, disclosure, or access. These safeguards include transport-layer encryption for data in transit between your browser and the Site, access controls, and use of reputable hosting and email infrastructure providers. Notwithstanding these measures, no method of transmission over the internet or method of electronic storage is completely secure, and we cannot guarantee the absolute security of any information.
8. International Data Transfers
We are based in the United States, and our service providers may process Personal Information in the United States or other jurisdictions. By using the Site or submitting information through the contact form, you understand that your Personal Information may be transferred to, stored in, and processed in jurisdictions whose data-protection laws may differ from those of your country of residence.
9. Children's Privacy
The Site is intended for adults and is not directed to children under the age of sixteen (16). We do not knowingly collect Personal Information from children under sixteen. If you believe that a child has provided Personal Information to us, please contact us using the methods described below so that we may take appropriate action to delete the information.
10. Your Rights and Choices
Subject to applicable law, you may have certain rights with respect to your Personal Information, which may include the right to: (a) access or obtain a copy of the Personal Information we hold about you; (b) request the correction of inaccurate or incomplete Personal Information; (c) request the deletion of Personal Information, subject to applicable recordkeeping obligations; (d) object to or restrict certain processing activities; (e) withdraw consent where processing is based on consent; and (f) lodge a complaint with a competent data-protection authority.
To exercise any of these rights, please contact us using the information provided below. We may need to verify your identity before responding to your request, and we may decline requests where permitted by law.
11. Do Not Track
Because no industry standard has been established for "Do Not Track" signals, the Site does not currently respond to such signals. As stated above, we do not engage in cross-site tracking or behavioral advertising on the Site.
12. Third-Party Links
The Site may contain links to third-party websites or services that are not owned or controlled by us. This Policy does not apply to information collected by such third parties, and we are not responsible for their privacy practices. We encourage you to review the privacy policies of any third-party services you visit.
13. Changes to This Policy
We may update this Policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors. When we make material changes, we will update the "Last Updated" date at the top of this Policy and, where appropriate, provide additional notice through the Site. Your continued use of the Site following any update constitutes your acknowledgment of the revised Policy.
14. Contact Us
If you have any questions, concerns, or requests regarding this Policy or our privacy practices, please contact us through the Contact page on this Site. Please include sufficient information to allow us to respond to your request.
